Human Rights for Zimbabwe

Anyone celebrate the 60th Anniversary of the Universal Declaration of Human Rights? That much translated document which is not legally binding as law, but has had a profound effect on cultures and civilisations.

I memorised much of it (just like I memorised much of the Magna Carta), and then I discovered that our own Lancaster House Constitution also has a chapter on Human Rights. I will never forget the first time I used it, to challenge the legality of a roadblock mounted by the police on the Mutare Road. Looking back, it was a dumb-ass thing to do- they could have beaten the shit out of me and none of my fellow passengers would have so much as blinked to help me.

It has been argued by Mugabe's apologists among Black activists in the West that Africa's concept of Human Rights is different and should not be evaluated by Western standards. But who said they are Western standards in the first place? Isn't it convenient, to name something as Western in order to reject it outright?

I celebrate the UDHR's Anniversary, but I am mindful that all over the world, even in those countries that believe themselves to be the standard by which all other nations are measured- there is yet to be achieved not only a culture of human rights, but an assurance of its continuance. The recent arrest of a British MP is greeted by some that this country, which gave us the Magna Carta, is degenerating in to a Stalinist state. It is to be noted that some of the placards protestors held over the incident read:THIS IS NOT ZIMBABWE......

But are we that bad? Yes, and then some. Yesterday, someone called me to say that a friend of his worked on a police operation to recover the body of a drowned man in a lake in Marondera. They found 18 bodies in that lake. CIO people arrived on the scene and advised them to focus their attention on just the one they were looking for and forget about these others. When Idi Amin took people he did not like for swimming lessons, the world said that it was because he wasn't educated. What excuse do we have for a man who has several degrees?

I could go on with examples of Zimbabwe's serious human rights problem. What has never been explored though, is the apathy of the average person. We know what is going on, and yet we do not speak out. What have we got to lose? Our lives? What lives? If they could come for the man down the street for a careless remark on the bus, is there any guarantee they won't come for you and me? The problem is not that some people don't know when to shut the fuck up, but that there are people who think they can get away with visiting other people at night and taking them away. If we think this is wrong, we have to stop it.

I thought I'd start with a little reminder of what basic human rights are. Please read below, and understand.

Isivumelwano
Abantu bonke bazalwa bekhululekile njalo belingana kumalungelo abo. Balesipho sikanembeza, ngakho bamele baphathane ngomoya otshengisa ubuhlobo lobunye.

Isivumelwano 2
Wonke umuntu ulelungelo lokuthola inkululeko lamalungelo alotshwe kulesi sivumelwano hngokupheleleyo kunganakwa ubuhlobo, umbala, ukuthi uyindoda kumbe ngumfazi, ulimi, ukholo, ezimayelana lombangazwe, lenotho kanye lasipi lasiphi isimo phakathi kwabantu.
Njalo kakusoze kube lomahluko ekuphathweni kwabantu emthethweni loba ngowaliphi ilizwe loba yisiphi lesimo selizwe lapho umuntu avela khona - lanxa lelolizwe lizibusa kumbe libuswa ngelinye.

Wonke umuntu ulelungelo lempilo, lelenkululeko lelenhlalakahle.

Isivumelwano 4
Kakho umuntu ozakwenziwa isigqili, kumbe isithunjwa; ubugqili lokuthengisa izichaka kuzanqatshelwa ngazo zonke indlela.

Isivumelwano 5
Akula muntu ozahlutshwa ahlukuluzwe loba aphathwe ngesihluku langendlela eyangisayo kumbe elocuku.

Isivumelwano 6
Wonke umuntu ulelungelo emthethweni lokuphathwa njengomuntu.

Isivumelwano 7
Bonke abantu bayalingana phambi komthetho, kungekho bandlululo. Abantu bonke bayavikelwa ekubandlululweni. Ubandlululo luvunyelwa yisivumelwano lesi njalo akuvunyelwa ukubasela ubandlululo.

Isivumelwano 8
Omunye lomunye umuntu ulelungelo lokuvikelwa ngababusi lomthethwandaba uma kulezenzo ezephula amalungelo akhe asemthethweni.

Isivumelwano 9
Akumelanga ukuthi umuntu abotshwe okungekho emthethweni, loba abotshwe mahlayana, loba axotshwe elizweni lakubo.

Isivumelwano 10
Omunye lomunye umuntu ulelungelo lokuthi athoniselwe icala phambi kwenkundla ezimeleyo kumbe agwetshwe yinkundla engabandlululiyo ekuthetheni amacala.

Isivumelwano 11
Omunye lomunye umuntu owetheswe icala ulelungelo lokuthi aphathwe njengomuntu ongela cala aze adliwe licala emthethwandaba. Kumele njalo aphiwe ithuba lokuthola umeli.
Kakho umuntu ongajeziswa emthethweni ngenxa yecala alenzayo uma icala leli lenziwa umthetho owenza lokho akwenzayo kube licala wawungekho ngaleso sikhathi. Isijeziso salelo cala akumelanga sedlule isijesiso esasifanele icala lelo umthetho omutsha ungakabekwa.

Omunye lomunye umuntu ulelungelo lokuhlonitshwa - ubuntu bakhe, imuli yakhe, umuzi wakhe lezincwadi zakhe. Omunye lomunye umuntu kumele avikelwe ngumthetho ezintweni ezinje.

Wonke umuntu ulelungelo lokuhamba lokuhlala kuwo wonke amazwe.
Wonke umuntu ulelungelo lokuthutha loba kuliphi ilizwe, ngitsho laselizweni lakhe, lelokubuyela elizweni lakhe.

Isivumelwano 14
Wonke umuntu ulelungelo lokubalekela kwelinye ilizwe ukuze abe yisiphepheli khona nxa ehlutshwa elizweni lakubo.
Leli lungelo alikhululi umuntu obotshiweyo ngaphandle kokuba ebotshelwe izindaba zombangazwe kumbe okungavunyelwa ngaMazwe aManyaneyo.

Umendo kumele ubotshwe ngukuvumelana kwabathathanayo.

Omunye lomunye ulelungelo lokucabanga njengokuthanda kwakhe, lelokukhonza ngentando yakhe, ekhokhelwa ngunembaza wakhe. Leli lungelo lipha umuntu imvumo yokutshintsha ukholo lwakhe, lemvumo yokuthi yena yedwa kumbe elabanye atshengise ukholo lwakhe kumphakathi ngezenzo, ngokukhonza, ngokufundisa kunye Tokuziphatha kwakhe kunye lokufundisa ukholo lwakhe.

Omunye lomunye ulelungelo lokukhuluma izifiso zakhe lokusengqondweni yakhe. Leli lungelo lipha umuntu inkululeko yokudinga lokwamukela lokwazisa akwaziyo lokusengqondweni yakhe ngayiphi layiphi indlela lakwamanye amazwe.

Izifiso zabantu yizo okumele ziphe uhulumende amandla okubusa. Lezi zifiso zizatshengiswa lukhetho oluzakwenziwa ngezikhathi ezifaneleyo, oluzavumela njalo wonke umuntu ukukhetha ngendlela engasoze itshengise abanye ukuthi ukhethe bani.

Omunye lomunye umuntu, njengesakhamuzi, ulelungelo lokusekelwa yilizwe lakhe lelokusuthiseka. Lokhu kuzavela ezenzweni zesizwe sakhe lasencedweni oluvela kwamanye amazwe, ukuze kuthuthukiswe amalungelo akhe empilweni lasemasikweni akhe ukuze kumlethele inhonipho lentuthuko yobuntu bakhe.

Omunye lomunye ulelungelo lokusebenza lelokukhetha umsebenzi awufunayo, lelokuphathwa kuhle emsebenzini, lelokuncedwa nxa umsebenzi udingakala
Omunye lomunye ulelungelo lokwamukela imbandalo elingene lomsebenzi wakhe.
Wonke umuntu osebenzayo ulelungelo lokuthola imbadalo efaneleyo ezokwenza ukuthi yena labantwana bakhe bathole impilo lenhalakahle ehloniphekayo njengabantu, lelokusekelwa ngezinye izindlela.
Omunye lomunye ulelungelo lokuba lilunga lomhlangano wezisebenzi ukuze asekele izifiso zakhe.

Omunye lomunye ulelungelo lokuthatha ikhefu engephulelwa imbadalo yakhe, njalo ulelungelo lokusebenza amahora angamanengi kakhulukazi.

Isivumelwano 25
Omunye lomunye ulelungelo lempilo lenhlalakahle yakhe labantwana bakhe. Lokhu kuhlanganisa ukudla, izembatho, indawo yokuhlala kanye lempilo enhle, ukugcinwa kuhle uma engasebenzi. Lokhu kuhlanganisa abafelwaokazi, abadala, abalimeleyo labehlulekayo ukuzonga.
Ababelethileyo labantwana kumele bagcinwe njalo bancediswe. Abantwana bonke abazalelwe emendweni kumbe ngaphandle kwawo, kumele basekelwe ngokufanayo.

Omunye lomunye ulelungelo lemfundo. Imfundo ayizukuba lembadalo, kusukela phansi kuze kufike esigabeni esithe thuthu. Imfundo ephansi (elementary) ngeyomuntu wonke, ngakho omunye lomunye uzabanjwa ngamandla ukuthi ayithole. Imfundo ephezulu yezandla (technical) lenye njalo eyolwazi olwehlukeneyo olwezigaba ezehlukeneyo kumele ibe khona, lemfundo ephakemeyo kumele itholwe yilabo abayifaneleyo ngolwazi abalalo.
Imfundo kuzamela ithuthukise ubuntu lokuhlonipha amalungelo obuntu lenkululeko engcweleyo. Kufanele ikhulise ukuzwelana, ukuzwisisa lobudlelwano phakathi kwezizwe zonke, kwemihlobo yonke lakwabenkonzo ezehlukeneyo, isekele njalo imisebenzi yeZizwe eziManyeneyo (UN) yokuletha ukuthula emhlabeni.

Omunye lomunye ulelungelo lokusekelwa empilweni yakhe lelokuqiniswa ebuntwini bakhe mayelana lokwemvelo lokwezombukiso.

Umuntu munye lamunye ulelungelo lokuthola indawo lapha okuhlonitshwa lokugcinwa khona izimiso zezivumelwano lezi.

Wonke umuntu ulemisebenzi okumele ayenze njengesakhamuzi okuyiyo ezagcwalisa ubuntu bakhe.
Kukho konke akwenzayo, uzakhokhelwa yikuhlonipha lokwethula ingowane yakhe kumalungelo abanye, ananzelele ukuqakatheka kombuso wabanengi (UN).

(Chechitatu) - Munhu wese anoshanda anekodzero yokuwana mugove wakanaka zvichiita kuti iye pachake nemhuri yake vawane magariro anokodzera ehunhu uchiwederwa, kana zvichikodzera nedzimwe nzira dzokuchengetedzwa kwemagaririo akanaka.
(Chechina) - Munhu wese anekodzero yokuumba nokuvanhengo yemasangano anomirira vashandi kuti agone kuchengetedza zvido zvake.

26. Chisungo chechimakumi maviri nenhanhatu
(Chekutanga) - Munhu wese anekodzero yokuwana dzidzo iyo ichange iri pachena , zvikuru panguva yehwana hudiki, inova ndiyo nguva yakakosha. Dzidzo panguva iyi ichamanikidzirwa. Dzidzo dzezvemibato yemaoko neyemumahofisi ichaitwa kuti ivepo zvekare, dzidzo iripamusoro ichawanikwa maererano nemagonero emunhu.
(Chechipiri) - Dzidzo ichanangiswa kusimudzira zvakakwana munhu nokusimbaradza kuremekedzwa kwekodzero dzavanhu uyewo nerusununguko rwavo runokosha. Dzidzo ichakuridzira kunzwisisa, kuregererana nohusahwira pakati penyika, marudzi kana mapoka ezvedzisvondo, uyewo ichatungamidza mabasa emubatanidzwa weNyika dzepasi pose ekuchengetedzwa kwerunyararo.
(Chechitatu) - Vabereki vanekodzero yokusarudza dzidzo ichapihwa kuvana vavo.

I big you Rasta. Keep educating dem. We share many views on many things. I especially enjoyed your article about the MDC. The SADC is hiding behind the endless power sharing talks,while people in Zimbabwe die. It's time our brethren Morgan Tsvangirai washes his hands off these talks and let SADC and AU or UN implement plan B,if they have any.I used to attend the Binghi in St Mary's when I was still in Zimbabwe.
